Terms and Conditions for the Location Promotion Short Film Contest
Please read the “Terms and Conditions for the Location Promotion Short Film Contest” (hereinafter, “these Terms”) carefully. These Terms apply when you (the “Participant”) participate in the short film contest (hereinafter, “the Contest”) hosted by MPA Korea LLC (hereinafter, “MPA Korea”) for short films (hereinafter, “Short Films”) that introduce live-action filming locations across South Korea.
By participating in the Contest, you are deemed to have agreed to these Terms. If you are under the age of 19, you must obtain prior consent from a legal guardian.
Article 1 (Contest)
MPA Korea will conduct and operate the Contest in accordance with these Terms and the detailed operational rules separately established by MPA Korea.
Details regarding the Contest and awards are subject to change at MPA Korea’s discretion.
Article 2 (Eligibility)
To participate in the Contest:
- You must be an individual, corporation, or organization that agrees to these Terms. Participation is open regardless of residence, address, or nationality.
- You must comply with all obligations under these Terms and must not violate or potentially violate them.
Article 3 (Submission Requirements)
Your Short Film submitted to the Contest must meet the following requirements, including any additional requirements set by MPA Korea: There are no restrictions on the equipment used for filming. You may use smartphones, digital SLRs, professional cameras, or any other equipment you deem appropriate.
- The Short Film must be between 60 and 90 seconds and filmed at a location legally permitted for filming in South Korea.
- The Short Film must be created by you (not by others) and must be either an unpublished work or a re-edited version of an existing work.
- The Short Film must be in MP4 or MOV format with a minimum resolution of 720p.
- The Short Film must not promote or advertise products or services provided by you or third parties.
- If generative AI technology is used in the creation of your Short Film, you must indicate this upon submission.
- You must comply with all obligations outlined in these Terms, including prohibited acts.
- MPA Korea must not have previously deemed your Short Film submission inappropriate.
Article 4 (Submission Method)
You must upload your Short Film to the video streaming platform (hereinafter, “Platform”) designated by MPA Korea by the Contest deadline, following the submission instructions. The submission deadline and method will be communicated separately by MPA Korea.
Article 5 (Participation Fee)
No separate participation fee is required. However, all costs, fees, and expenses incurred in producing and submitting the Short Film, including production and communication costs, are the responsibility of the Participant.
Article 6 (Judging and Results)
All Short Films submitted will be judged according to the method separately established by MPA Korea.
MPA Korea will announce the results and award winners via the Platform or by another method deemed appropriate.
Participants may not inquire about the judging criteria, the process, specific winners’ reasons, or any other related matter, nor may a third party inquire on their behalf. MPA Korea has no obligation to respond in such cases.
Article 7 (Participant Obligations)
To participate in the Contest, you must:
- Obtain all necessary rights for third-party works (including music) included in the Short Film.
- Obtain all necessary rights regarding any person appearing in the Short Film, including portrait rights, publicity rights, privacy rights, and property rights.
- Comply with other rules and regulations set by MPA Korea related to Contest participation.
Article 8 (Prohibited Acts)
You may not, and must not intend to, engage in the following acts in producing, participating in, or streaming your Short Film via the Platform:
- Infringing on copyrights, patents, utility model rights, trademarks, or other intellectual property, publicity, personal, privacy, or legal/contractual rights of MPA Korea or third parties.
- Including expressions that may cause discrimination based on race, nationality, belief, gender, social status, or origin; excessive violence; sexual explicitness; encouragement of suicide, self-harm, or substance abuse; or any antisocial or offensive content.
- Including sexual acts or obscene content.Including harassment, defamation, or content that may offend third parties.Violating laws, court orders, or administrative directives from national or local authorities.Promoting illegal or immoral acts.Violating public order or good morals.Overloading or damaging MPA Korea servers, networks, or computer systems.Interfering with MPA Korea’s activities (including the Contest) or other participants’ participation.Spreading false information, fraud, or using violence to damage MPA Korea’s reputation or operations.Any acts deemed inappropriate or prohibited by MPA Korea.
Article 9 (Disqualification)
If MPA Korea determines that a submission violates or may violate these Terms (including submission requirements, participant obligations, and prohibited acts), MPA Korea may, at its sole discretion, disqualify the Short Film, exclude it from judging, or stop streaming it.
MPA Korea is not responsible for any damages incurred by the Participant or third parties due to such actions.
Article 10 (Personal Information)
Unless otherwise specified, MPA Korea may use personal information provided for the purpose of conducting and operating the Contest (e.g., communication with participants, sponsors, or related parties).
MPA Korea will manage personal information in accordance with relevant privacy laws, regulations, guidelines, and MPA Korea’s privacy policy.
MPA Korea will not provide personal information to third parties unless required by law, privacy policy, legitimate reasons, or with the Participant’s consent.
Article 11 (Intellectual Property Rights)
You or a designated third party must be the sole copyright holder of your Short Film.
You agree to grant MPA Korea a license to use your Short Film for Contest operations (e.g., announcing results, posting and distributing via media) and promotion of MPA Korea’s activities (including the Contest), including streaming on the Platform.
You grant MPA Korea a worldwide, non-exclusive license for 5 years from the end of the Contest to screen or stream your Short Film at domestic or international events hosted by MPA Korea or its designated companies for the benefit of Contest sponsors and related parties.
Article 12 (Indemnification)
If you violate your obligations under these Terms (including prohibited acts) and cause damage to MPA Korea or third parties, you are responsible for all losses and damages at your own cost.
Article 13 (Confidentiality)
You must keep MPA Korea’s confidential information (including all information regarding members, customers, activities, services, business know-how, ideas, or concepts disclosed to you) confidential and may not disclose it to third parties without written consent, except as required by law or court order.
Article 14 (Amendment of Terms)
MPA Korea may modify, amend, or adjust these Terms in accordance with Korean Civil Law. The amended Terms and their effective date will be posted on the Platform or MPA Korea’s website or communicated to participants by other means.
Article 15 (Prohibition of Transfer of Rights)
You may not transfer, assign, or pledge your rights or obligations under these Terms to third parties without prior written consent from MPA Korea.Article 16 (Governing Law and Jurisdiction)These Terms are governed by the laws of the Republic of Korea.
All disputes arising between MPA Korea and Participants regarding these Terms or the Contest shall be subject to the exclusive jurisdiction of the Seoul Central District Court as the court of first instance.
